Australian Solutions Centre is committed in assisting people understand their rights under the Building & Construction Industry Security of Payment Act in the respective states. The Security of Payment Act(s) allow for the rapid determination of progress claims under a building contract to ensure that any person who undertakes to carry out construction work or the supply of related goods and services is entitled to receive and recover progress payments.
The scheme is designed to ensure cash flow to businesses in the building and construction industry without getting tied up in lengthy and often expensive litigation or arbitration.
The Building & Construction Industry Security of Payment Act first commenced in NSW by government in response to industry appeals for a solution to a major problem plaguing the construction industry – getting paid on time. In order to achieve this goal the government appointed Authorised Nominating Authorities (ANA) to facilitate the process and appoint adjudicators to determine the payment dispute.
Australian Solutions Centre applied for registration and was subsequently appointed as an ANA.
“Australian Solutions Centre helped our business receive payments from various creditors that we thought were simply not going to pay us. Australian Solutions Centre assisted with the careful presentation of information required.”
Robyn Hillman is the Director of ASC and made a mammoth leap of faith in applying for registration as an ANA. Robyn was working for the largest demolition contractor in NSW in a well-paid and enjoyable employ and was faced with the decision of starting a new company with new legislation being introduced that was not really understood at the time. She made the leap and has not looked back since. ASC has since gone from strength to strength gaining authorisation in Victoria in 2002, Queensland in 2004, Tasmania in 2009, the Australian Capital Territory in 2009 and South Australia in 2009.
Our goal is to remove the conflict and offer structured, reliable assistance. We understand the frustration businesses feel when cash flow is being constricted due to payments being withheld by unprincipled practices and we empathise with those businesses that collapse. We are passionate about what we do, it’s who we are.
“I have been using Australian Solutions Centre for 10 years as both a Head Contractor and Sub-Contractor. I have always found them to be professional and helpful enabling me to comply with all requirements of the Security of Payments Acts in multiple states and territories”.
- Must abide by the Act and associated regulation;
- Have their own fee structures;
- Have a panel of adjudicators;
- Train adjudicators (link to Adj Training Website); and
- Provide advice on the Act and the process.
So what makes ASC different?
- We are ethical – challenges which have been made and seen ASC withstand the test;
- We have the best panel of adjudicators who make sound determinations to withstand court intervention;
- We continually follow up;
- We are professional and compassionate, especially when faced with an unhappy participant, and;
- We are often complimented on our advice and understanding, particularly as the building and construction industry is largely a male dominant one.
- If it is a fixed price, that's exactly what it is. We don't have any conditions.
The parties involved in the Security of Payment process are.........................................................

A body appointed by the respective State Minister
The party making the payment claim (who is owed money)

|“Our business has been gaining assistance from ASC for nearly five years now. Prior to being in touch with ASC and being assisted by them to use the Building & Construction Industries Security of Payment Act 1999 we occasionally had disputes with customers over payment for work that had been done. ASC have helped us with the preparation of making payment claims using the proper and correct procedure making it fair for both parties. We can honestly say that having ASC there to adjudicate has taken a great amount of pressure from our company. Having ASC services helps parties involved to be paid fairly for work or services rendered without any ongoing disputes. This can only improve business and has most definitely improved ours.The girls at ASC are always on hand with any queries you may have and have certainly helped our business flow more smoothly we wouldn’t be without them. We would highly recommend any company with disputes over payments to contact ASC to help with the proper procedures of getting paid.”|
